Is delta-8 legal in Utah?

Not legal

No. Utah counts compounds substantially similar to delta-9 THC, such as delta-8 and delta-10, as THC analogs, and a cannabinoid product's combined total THC and THC analogs must stay under 0.3% by dry weight. Utah law also lists artificially derived cannabinoids as an adulterant and names THCP, HHC and THC acetates as non-compliant material.

  • Delta-8 vapes are also covered by Utah's July 1, 2026 ban on cannabinoid vapes.

Is THCA flower legal in Utah?

Not legal

No. Utah law makes it unlawful to sell a cannabinoid product that is smokable flower, and UDAF rules bar hemp flower as a final product.

  • Utah counts THCA in total THC (delta-9 THC + THCA x 0.877), so THCA-rich products fail the 0.3% limit.

Are hemp vapes legal in Utah?

Not legal

No. Since July 1, 2026, it is a crime in Utah for an employee to sell or give a cannabinoid inhalation product, meaning any electronic cigarette that contains a cannabinoid, in the course of business. This covers CBD vapes, not just THC.

  • Utah law also says an e-cigarette is not a cannabinoid product, so hemp vapes can't be registered with UDAF.
