Why is THC per jar the problem?
The new federal rule counts THC per container, not per gummy.
One 5 mg THC gummy is already over the 0.4 mg cap. A jar of 30 is 150 mg. From December 11, 2026 that jar is no longer hemp under federal law. Most hemp THC gummies sold today fall in this group. More on the dates: the federal hemp ban.
Does the FDA allow CBD in food?
No. The FDA says it’s a prohibited act to sell food with added CBD across state lines, and CBD can’t be sold as a dietary supplement. Gummies are sold widely anyway. The FDA has sent warning letters to brands claiming CBD treats or cures diseases. Skip any brand that makes health claims.
What should I check before buying?
- A batch lab report (COA) that matches the lot number on the jar.
- Total THC per jar, not just per gummy. Delta-9 plus 0.877 × THCA.
- The age rule in your state. Texas sells to 21 and up only.

Are CBD gummies legal in every state?
Federal law doesn’t settle it. States decide what can be sold, to whom and in what form. We publish a state’s answer only after checking its official sources, and all 50 states and DC are now checked. Find yours in the state table. In Texas, for example, CBD gummies are legal for adults 21 and older.
