Can you fly with CBD?

Short answer

Yes, within the US, if it's hemp CBD with no more than 0.3% THC or an FDA-approved product. That's TSA's own rule. Two catches: the law where you land, and the new federal cap from December 11, 2026.

What does TSA say about CBD?

TSA’s page says cannabis products, “including some Cannabidiol (CBD) oil”, are illegal under federal law “except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by FDA.”

So hemp CBD is allowed. TSA also says its officers don’t search for drugs. If they find something that may be illegal, they call law enforcement.

Carry-on or checked bag?

Both work.

  • Oils and tinctures follow the liquids rule in your carry-on: 3.4 oz (100 ml) or less per bottle, inside one quart-size bag.
  • Gummies and capsules aren’t liquids. Pack them normally.
  • Creams and lotions count as liquids, so the same 3.4 oz rule applies.
  • Bigger bottles go in checked bags.

Why does your destination matter?

Once you land, that state’s law applies. A product legal at home can be illegal where you arrive.

Texas is a good example. CBD oil is fine for adults 21 and older. Delta-8, THCA flower and hemp vapes are not. Full answer: is CBD legal in Texas. For other states, pick yours on the map.

What changes on December 11, 2026?

The federal definition of hemp tightens. A finished product can hold no more than 0.4 mg of total THC per container. Many full-spectrum oils hold far more. A 30 ml bottle at 0.2% delta-9 has about 55 mg.

After that date, such a bottle isn’t federal hemp anymore, even though TSA’s page still quotes the old 0.3% test. An isolate or broad-spectrum product with no detectable THC is the lower-risk choice to fly with. “Not detected” only means below that lab’s detection limit, so keep the batch lab report with the product, and check the law where you land. Can you fly abroad with CBD?

Treat it as a separate question. Other countries set their own rules, and some ban CBD outright. Check the destination’s official customs guidance before you pack it.

How should you pack it?

  • Keep it in the original labeled package.
  • Carry the batch lab report, printed or on your phone.
  • Pick isolate or broad-spectrum if you can.
  • Leave delta-8, THCA and anything with a THC dose at home.
