Is CBD federally legal?

Short answer

Yes, if it comes from hemp, with limits. Since the 2018 Farm Bill, hemp CBD isn't a controlled substance. That isn't blanket approval: the FDA says CBD can't be added to food or sold as a dietary supplement across state lines, and your state can set its own rules. From December 11, 2026, a new federal rule caps hemp products at 0.4 mg of total THC per container, so some full-spectrum products will stop counting as hemp.

Where it comes from. The 2018 Farm Bill took hemp off the federal controlled substances list. Hemp means cannabis with no more than 0.3% delta-9 THC by dry weight. CBD made from that plant is hemp. CBD made from marijuana is not.

What changes on December 11, 2026?

The definition of hemp gets tighter. A new federal law, section 781 of Public Law 119-37, adds three tests:

  • THCA now counts toward the 0.3% limit, not just delta-9.
  • A finished product can hold no more than 0.4 mg total THC per container.
  • Cannabinoids made or converted outside the plant don’t count as hemp.

It was set for November 12, 2026. Congress pushed most of it to December 11. Full dates and product list: the federal hemp ban.

Depends on the THC in the whole bottle.

Take a 30 ml full-spectrum oil at 0.2% delta-9. That’s legal today. After December 11 it holds about 55 mg of THC per bottle, roughly 138 times the new cap. An isolate oil whose lab report shows no detectable THC is far more likely to pass, though “not detected” only means below that lab’s detection limit. Check the whole container against the 0.4 mg cap.

Is CBD FDA approved?

One product is. Epidiolex, a prescription drug for two rare seizure conditions. Nothing else.

The FDA also says CBD can’t be added to food or sold as a dietary supplement across state lines. It has sent warning letters to brands claiming CBD treats or cures diseases.

States write their own rules, and many are stricter. In Texas, CBD oil is legal for adults 21 and older, but delta-8, THCA flower and hemp vapes are not. Full answer: is CBD legal in Texas.

Is marijuana-derived CBD federally legal?

No. The federal exemption covers hemp only. CBD from marijuana is still treated as marijuana under federal law.
